The plaintiff, Patrick A. Lemberger, was injured in July of 1966 while an employee of the Hedrich Construction Company, which
was building a bridge near Osseo, Wisconsin, for the projected interstate highway system. Lemberger and a co-employee were
working in the bed of a stream where a cofferdam was being constructed preparatory to pouring a concrete footing for the bridge
support. The cofferdam was to be a rectangular structure formed by sheeting driven into the stream bed. After the cofferdam
was completed, the stream bed was to be clammed out and the area filled with concrete. It was the job of Lemberger and his co-employee Engebretson to place the sheeting in position. After the sheeting was positioned,
a crane operator used a drop hammer to drive the sheeting into the earth. During the time the drop hammer was in operation,
Lemberger's job was to stand aside, to signal the crane operator, and to be sure the sheeting was driven straight. At the
time in question, the sheeting had been placed, and Lemberger and Engebretson moved away from the area where the piling was
being driven but were positioned so they could watch to insure that the sheeting was plumb and driven into the ground at the
proper angle.
